By accessing and using Supawake, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

1.1. Relationship with Varmada

Supawake is a product of Varmada and operates under Varmada's licensing agreements and policies. This Terms of Service applies specifically to Supawake, and your use of Supawake is also governed by Varmada's Terms of Service and Privacy Policy, which can be found at https://varmada.com/tos and https://varmada.com/privacy.

By using Supawake, you acknowledge that you have read, understood, and agree to be bound by both this Terms of Service and Varmada's Terms of Service. In the event of any conflict between this agreement and Varmada's terms, Varmada's terms shall take precedence to the extent of such conflict.

2. Description of Service

Supawake is a service that automatically pings your Supabase projects to prevent them from entering a sleep state. The service monitors and maintains the activity of your connected Supabase projects through automated pings at regular intervals.

3. User Accounts

To use our service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the service or servers
• Use the service for any illegal or unauthorized purpose

5. Service Availability

We strive to provide a reliable service but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. We are not liable for any damages resulting from service interruptions.

6. Pricing and Payments

Our service offers both free and paid plans:

• Free Plan: Allows management of 1 Supabase project at no cost
• Pro Plan: Monthly subscription at $3/month or annual subscription at $20/year for unlimited projects

Payments are processed through secure third-party payment processors. Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time.

7. Data and Privacy

Your use of the service is also governed by our Privacy Policy. We collect and process your data as described in the Privacy Policy. By using the service, you consent to such processing and warrant that all data provided by you is accurate.

8. Intellectual Property

The service and its original content, features, and functionality are owned by Supawake and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service.

9. Limitation of Liability

To the maximum extent permitted by law, Supawake shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless Supawake, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the service or violation of these terms.

11. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately. You may also terminate your account at any time by contacting us.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the service after any changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
